The Court allowed the application for anticipatory bail, granting the petitioner relief subject to bond and surety conditions.

Summary

The petitioner, Sanjay Singh, sought anticipatory bail fearing arrest in a case (Madhuban P.S. Case No. 343 of 2024) involving multiple offences under the Bharatiya Nyaya Sanhita, 2023 and the Arms Act. The prosecution alleged that he assaulted a victim with a hard blunt object and fired at an informant, though the bullet did not hit anyone. The petitioner pleaded innocence and argued that no offence was committed. The State opposed the bail, contending the seriousness of the charges. After considering the facts and the nature of the allegations, the Court allowed the anticipatory bail, directing the petitioner to furnish bail bonds and sureties subject to conditions under Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in view of the alleged offences under the BNSS and the Arms Act
