Patna High Court

Rupesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond of Rs.10,000 and stipulated conditions.

Summary

Rupesh Kumar was arrested on 21-12-2025 in connection with FIR 05-12-2025 for offences under Sections 331(4) and 305 of the Bharatiya Nyay Sanhita, 2023. He contended that he was not named in the FIR and was implicated only through a self‑confessional statement, asserting his innocence. The prosecution opposed bail, citing two prior criminal antecedents, but also noted that the petitioner was already on bail for those matters. The court noted that a co‑accused, Santosh Patel, had previously been granted bail and, after considering the facts, ordered the release of Rupesh Kumar on bail with a bond of Rs.10,000 and specific conditions. The bail order includes requirements of cooperation with the trial, presence in court, and non‑tampering with evidence, with provision for cancellation if antecedents are concealed.

Issues considered

  • Whether bail should be granted to the petitioner under Sections 331(4) and 305 of the Bharatiya Nyay Sanhita, 2023 despite alleged prior criminal antecedents.
  • Whether the petitioner’s alleged false implication and the differences in recovered articles affect the bail decision.

statement of the petitioner. Although, prosecution has claimed

that recovery has been made from the house of the petitioner but

paragraph-3 of the bail application that the petitioner is on bail

          in the said matters.

                       6. Considering the aforesaid facts and circumstances,
