Patna High Court

Rohit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to monetary and procedural conditions.

Summary

The petitioner, Rohit Kumar, was arrested in connection with a case alleging possession of a loaded pistol and cartridges, offences under Sections 25(1-b)(a), 26 and 35 of the Arms Act. He claimed innocence, asserting that the weapons were planted by police and that nothing was found in his conscious possession. The State opposed bail, while the petitioner’s counsel argued lack of criminal antecedents and false implication. The Court, after considering the submissions, granted bail on a cash bond of Rs.10,000 with two sureties, imposing conditions such as cooperation with the trial, presence at hearings, and restrictions on tampering with evidence. The bail order also required a blood relative as one bailor and stipulated cancellation of bail for non‑compliance.

Issues considered

  • Whether bail should be granted to the accused in offences under the Arms Act (Sections 25(1‑b)(a), 26, 35).
  • Whether the circumstances of alleged planting of evidence and lack of prior criminal record justify bail.
  • Whether the conditions imposed are sufficient to safeguard the trial process.
