The court granted regular bail to the petitioner.

Summary

The petitioner, Ankit Kumar, was arrested in connection with the seizure of 345.6 litres of illicit foreign liquor from a pick‑up vehicle, alleged to be a violation of Sections 30(a), 32(i)(iii) and 41(i)(ii) of the Bihar Prohibition and Excise Amendment Act. He contended that he was merely the driver, had no knowledge of the contraband, and that the police failed to comply with Section 105 of the B.N.S.S. during the seizure. The State opposed bail, citing two prior similar offences against the petitioner. After hearing both sides, the court considered the lack of knowledge, procedural irregularities, and the petitioner’s custody since 25‑02‑2026, and decided to grant regular bail on a bond of Rs 10,000 with two sureties. The order directs his release subject to satisfaction of the Special Judge, Excise‑II, Kaimur.

Issues considered

  • Whether the petitioner is entitled to regular bail despite alleged involvement in a large illicit liquor seizure.
  • Whether the alleged non‑compliance with Section 105 of the B.N.S.S. during seizure affects the bail application.
  • Whether the petitioner’s prior criminal antecedent of two similar cases precludes the grant of bail.

                       cases of similar nature.
