The petitioner is entitled to regular bail in the NDPS case.

Summary

The petitioner, Ramesh Gupta, was named by a co-accused in a seizure of 2.43 kg of ganja under Sections 20(b)(ii)(B) and 29 of the NDPS Act. No contraband was recovered from his possession and he claims innocence, citing a prior acquittal in another case. He has been in judicial custody since 9 February 2026. The State opposed his regular bail application. The Court, after considering the facts, held that the petitioner is entitled to bail, noting the quantity is less than commercial and there is no direct evidence against him. He was released on bail upon furnishing a bond of Rs.10,000 with two sureties.

  • Whether the petitioner is entitled to regular bail under Sections 20(b)(ii)(B) and 29 of the NDPS Act
