The court granted regular bail to the petitioner.

Summary

Reena Marandi was arrested in connection with a case under section 30(a) of the Bihar Prohibition and Excise Act after 80 litres of country-made liquor were allegedly recovered from her house. The petitioner contended that she had no possession of the liquor, that the seizure was recorded only by police personnel without independent witnesses, and that she had no prior criminal record, having been in judicial custody since 20 March 2026. The State opposed her request for regular bail. After hearing both sides, the High Court found merit in the petitioner's claims and ordered her release on regular bail, requiring a bail bond of Rs.10,000 with two sureties of the same amount. The order was directed to be complied with by the District and Additional Sessions Judge of the Exclusive Special Excise Court-II, Katihar.

Issues considered

  • Whether the petitioner is entitled to regular bail under section 30(a) of the Bihar Prohibition and Excise Act
