Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to a cash bond and sureties.

Summary

The petitioner, Chandan Roy, sought anticipatory bail in a case arising from a viral video showing him dancing while brandishing a country-made pistol, alleged under Sections 25(1) and 25(9) of the Arms Act. The petitioner claimed the case was politically motivated, asserted that the video’s authenticity could be challenged, and highlighted his clean criminal record and employment as a Block Resources Person. The State opposed the bail, arguing the seriousness of the offence. The Court examined the facts, the nature of the alleged offence, and the petitioner’s personal circumstances, and decided to grant anticipatory bail subject to a cash bond of Rs.10,000 and two sureties, with conditions under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita. The order directs that the bail be effective if the petitioner surrenders within six weeks.

Issues considered

  • Whether anticipatory bail is appropriate in a case under Sections 25(1) and 25(9) of the Arms Act
  • Whether the alleged offence is bailable or non‑bailable
  • Whether the video evidence is sufficient to justify denial of bail
  • Whether the petitioner’s clean record and employment justify grant of bail
