Holding

The court granted regular bail to the petitioner.

Summary

Kumod Mahto was arrested in connection with the seizure of 100 litres of country-made liquor from the dickey of a motorcycle, alleged to be the driver. The prosecution charged him under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner claimed innocence, stating that no liquor was found in his possession and that the seizure was not made in compliance with Section 105 of the B.N.S.S., and highlighted his clean record and custody since 4 March 2026. The State opposed regular bail, but the court, after hearing both sides, found the circumstances sufficient to grant bail. The court ordered his release on a bail bond of Rs.10,000 with two sureties, subject to the satisfaction of the Special Judge, Excise Court No.3, East Champaran.

Issues considered

  • Whether regular bail can be granted to an accused under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the seizure complied with the procedural requirements of Section 105 of the B.N.S.S.
  • Whether the petitioner’s lack of criminal antecedents and custody duration justify bail.
