The court granted bail to the petitioner subject to specified conditions.
Summary
The petitioner, Umashankar Thakur, the owner of a commercial vehicle, was implicated in a case where 138.475 liters of illicit liquor were recovered from his tempo under Section 30(a) of the Bihar Prohibition and Excise Act. He applied for bail, arguing that as the vehicle owner he should not be held liable for the driver’s alleged illegal acts and highlighted his clean antecedents. The State opposed the bail. The High Court, considering the facts and the petitioner's willingness to donate Rs.25,000 to a charitable organization, granted bail on the condition of a Rs.10,000 bond with two sureties and the deposit of the charitable amount, subject to Section 438(2) of the CrPC and Section 482 of the BNSS. The order was limited to the bail application and did not prejudice the merits of the trial.
Issues considered
- Whether the owner of a vehicle can be held liable for illicit liquor recovered from the vehicle under the Bihar Prohibition and Excise Act.
- Whether the petitioner is entitled to bail under Section 438 of the CrPC given the circumstances of the case.
