Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, a co‑driver of a truck, was arrested after police recovered 767.558 litres of illicit foreign liquor and charged under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act. He contended that he had no knowledge of the liquor, nothing was found in his possession, and the seizure violated Section 105 of the B.N.S.S. He also highlighted his clean record and that he had been in judicial custody since 29‑01‑2026. The State opposed the bail application. After hearing both sides, the High Court found the circumstances sufficient to grant regular bail, directing the petitioner to furnish a bail bond of Rs 10,000 with two sureties, subject to the satisfaction of the Exclusive Special Excise Judge‑II, Khagaria.

Issues considered

  • Whether the petitioner is entitled to regular bail under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.
  • Whether the alleged non‑compliance with Section 105 of the B.N.S.S. during seizure affects the bail claim.
  • Whether the petitioner’s role as co‑driver and lack of knowledge of the illicit liquor justify bail.
