Patna High Court

Deepak Kumar @ Deepak YadavversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court held that regular bail could not be granted and dismissed the bail application.

Summary

The petitioner, Deepak Kumar (also known as Deepak Yadav), was charged with offences under IPC sections 307, 504, 506 and 34, and Section 27 of the Arms Act for allegedly intercepting an informant and her father‑in‑law, assaulting and threatening them, and firing gunshots at a victim. He has been in custody since 19 February 2026 and is also an absconder in a related 2019 case. The petitioner applied for regular bail. The court examined the gravity of the allegations, the specific charge of discharging firearms, and his history of absconding. Considering these factors, the court declined to grant bail. The bail application was therefore dismissed, with the court noting that its observations were prima facie and not to prejudice the trial.

Issues considered

  • Whether regular bail should be granted to the petitioner given the seriousness of the offences, the specific allegation of firing gunshots, and his status as an absconder.
