Patna High Court

Sanjeet KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The bail application was allowed subject to specified conditions.

Summary

The petitioner, Sanjeet Kumar, was arrested in connection with a case involving 41.8 litres of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise Act. He had been in custody since 22 February 2026 and had a prior criminal antecedent from a 2023 case. The petitioner claimed innocence and offered to donate Rs. 25,000 to a charitable organization as a condition for bail, without admitting guilt. The State opposed the bail, but the court considered the custody period, the nature of the offence, and the petitioner’s antecedents. The court allowed the bail application, directing release on a Rs. 10,000 bond with two sureties, subject to the donation, monthly police attendance, and verification of criminal antecedents. The order was made clear to be prima facie and not to affect the trial’s merits.

Issues considered

  • Whether bail should be granted to the accused in a case under Section 30(a) of the Bihar Prohibition and Excise Act involving illicit liquor possession.
  • Whether the petitioner’s offer to donate Rs. 25,000 and his prior criminal antecedent affect the grant of bail.

petitioner’s criminal antecedents. If it is found that
the petitioner has any criminal antecedents other
than Harnaut P.S. Case No. 706 of 2023, the bail

2023, the bail bonds shall be accepted by the court
below. Such verification shall not, however, be used
as a ground to unnecessarily delay the acceptance
                                      of the bail bonds.

                                   8. It is made clear that any observation made herein is

prima facie in nature and limited solely for the purpose of

adjudication of the present bail application. Such observations

shall not be construed as an expression on the merits of the case

and shall not influence the trial or any other proceedings in any

                      manner.
