Holding
The application for regular bail is allowed.
Summary
The petitioner, Ajit Kumar Singh, was arrested on 26 February 2026 in connection with a case registered under several sections of the Bharatiya Nyaya Sanhita, 2023, alleging assault. The prosecution alleged that the petitioner assaulted the victim, while the petitioner claimed innocence, arguing that the allegations were vague and omnibus. The State opposed the bail application. The court considered the nature of the charges and the lack of specific evidence linking the petitioner to the alleged injury. It granted regular bail, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties of the same amount. The court clarified that its observations were prima facie and not determinative of the case's merits.
Issues considered
- Whether regular bail should be granted to the petitioner despite the general and omnibus nature of the allegations under the Bharatiya Nyaya Sanhita, 2023.
