Patna High Court

Deepak Singh @ Deepak Kumar SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that, since the illicit liquor was not recovered from the petitioner's physical possession and he has a clean antecedent, anticipatory bail should be granted.

Summary

The petitioner, Deepak Singh, was named in an FIR for alleged illegal manufacture and trade of illicit liquor, with 501.12 litres recovered under the Bihar Prohibition and Excise Amendment Act, 2016. He contended that he neither owned the vehicle used to transport the liquor nor had any physical possession of the contraband, and he has a clean antecedent. The Additional Public Prosecutor opposed his anticipatory bail. The court examined the factual submissions and noted that the recovery did not appear to be from the petitioner's possession. Consequently, the court directed that the petitioner be released on anticipatory bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances.
  • Whether the petitioner had actual possession of the illicit liquor recovered.
  • Whether the petitioner's clean antecedent warrants bail.
