Patna High Court

Dashrath Yadav @ Dasarth YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioners subject to specified conditions.

Summary

The petitioners, Dashrath Yadav and Sanjay Yadav, were arrested on 31 March 2026 in connection with a case involving the alleged possession of 60 litres of country-made liquor, alleged under Section 30(a) of the Bihar Prohibition and Excise Act, 2022. They claimed they had no conscious possession of the liquor, arguing that the seizure was from a vehicle and that they were falsely implicated, also contending non‑compliance with Sections 103 and 105 of the BNSS. The Additional Public Prosecutor opposed bail. The High Court considered the facts, the petitioners' clean antecedent, and the procedural issues, and ordered that bail be granted on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, presence in court, non‑tampering with evidence, and verification of criminal antecedent. The bail bond was to be accepted without delay for verification. The order was pronounced by Justice Rajesh Kumar Verma.

Issues considered

  • Whether the petitioners are entitled to bail under Section 30(a) of the Bihar Prohibition and Excise Act, 2022.
  • Whether the seizure of liquor from the vehicle implicates the petitioners as being in conscious possession.
  • Whether the procedural requirements of Sections 103 and 105 of the BNSS were complied with.
