Anticipatory bail was not granted to the petitioner.
Summary
Shivam Kumar applied for anticipatory bail after being implicated in a murder case involving a firearm, registered as FIR No. 86 of 2025. The FIR alleged his participation in planning and conspiracy to kill the deceased, with charges under multiple sections of the Bharatiya Nyaya Sanhita, 2023 and the Arms Act. The court examined the seriousness of the offences, the petitioner’s alleged role, and the risk of tampering with evidence or fleeing. Considering the gravity of the crime, the court declined to grant anticipatory bail. The petitioner was ordered to surrender within four weeks and seek regular bail, failing which the police were directed to arrest him.
Issues considered
- Whether anticipatory bail should be granted to the petitioner given the nature and gravity of the offences alleged under the Bharatiya Nyaya Sanhita and the Arms Act.
