The court granted regular bail to the petitioner, directing release on a bail bond of Rs.10,000 with two sureties.

Summary

Chandrama Rai was charged under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly possessing 25 litres of spirit. The petitioner claimed he was innocent, that no spirit was recovered from his possession, and that the seizure was not made in compliance with Section 105 of the B.N.S.S. He had no prior criminal record and had been in judicial custody since 4 April 2026. The State opposed his bail application. After hearing both sides, the court found the evidence insufficient and, considering the petitioner’s clean record, ordered his release on regular bail upon furnishing a bail bond of Rs.10,000 with two sureties of the same amount, subject to the satisfaction of the Special Excise Judge.
