Vikash Yadav @ Vikash KumarversusThe State of Bihar

Decided
Disposal
ALLOWED

Holding

The court held that the surrender period may be extended by eight weeks upon payment of Rs.10,000 and furnishing the bail bond receipt.

Summary

Vikash Yadav was convicted in a criminal case and was ordered to surrender and furnish a bail bond. He filed a petition seeking modification of the order dated 11-11-2025 to extend the surrender period. The petitioner argued for additional time to arrange the bail bond and deposit the required amount. The Court considered whether it could lawfully extend the surrender deadline and impose a monetary condition. It held that, subject to a deposit of Rs.10,000 with the District Legal Services Authority and submission of the receipt with the bail bond, an eight‑week extension could be granted. Consequently, the modification petition was allowed, extending the surrender period and imposing the deposit condition.

  • Whether imposing a deposit of Rs.10,000 as a condition for extension is permissible
