The court held that the petitioner is entitled to regular bail on furnishing a bail bond of Rs.10,000 with two sureties.

Summary

The petitioner, Ashutosh Kumar, was implicated in the murder of an informant's father and an e‑rickshaw driver, offences alleged under Sections 103(1) and 3(5) of the B.N.S. and Section 27 of the Arms Act. The prosecution’s case relied on a confessional statement of co‑accused Phool Babu Ram, who alleged that the petitioner, along with Arjun Paswan, shot the victims. The petitioner contended that he was falsely implicated and pointed to the same factual matrix that had led to bail being granted to co‑accused Arjun Paswan. The State opposed the bail application, arguing the seriousness of the charges. After considering the facts, the court found no compelling reason to keep the petitioner in custody and ordered his release on regular bail upon furnishing a bond of Rs.10,000 with two sureties. The petitioner was thus released from judicial custody pending trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged with murder and offences under the B.N.S. and Arms Act?
  • Whether the confessional statement of a co‑accused suffices to deny bail to the petitioner?

reached the place of occurrence and found the dead body of his

father lying on an e-rickshaw. The driver of the e-rickshaw was

present there and claimed that he could identify the assailants.

                       4. Learned counsel for the petitioner submits that the

petitioner is innocent and has committed no offence. He has

falsely been implicated in this case. Learned counsel for the

petitioner has submitted that the name of this petitioner has

transpired in this case in the confessional statement of co-

accused Phool Babu Ram that too in para ‘181’ of the case

diary. It has further been submitted that from perusal of the

order of learned trial Court, it is clear that learned trial Court has

recorded that Phool Babu Ram has stated in his confessional

statement categorically that it is he who has contacted with the

petitioner to eliminate the father of the informant and on the

fateful day on the order of Phool Babu Ram, this petitioner and

one Arjun Paswan shot bullet to father of the informant

          indiscriminately, causing his death.

                       5. Learned counsel for the petitioner has further

submitted that in postmortem, the father of the informant and

the e-rickshaw driver both have received one gun shot injury

each. It has further been submitted that co-accused Arjun

Paswan has already been granted bail by this Court vide Cr.

                                    6. Learned APP appearing for the State has

vehemently opposed the prayer of regular bail.
