Patna High Court

Pintu Saw @ BalaversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court held that the petitioner is not entitled to regular bail and rejected the application.

Summary

The petitioner, Pintu Saw @ Bala, was arrested in connection with a case where two persons allegedly fired upon a victim, resulting in firearm injuries. He was implicated based on a self‑inculpatory statement of co‑accused Aditya Bhargava @ Ashish Kumar and has been in custody since 27 September 2025. The petitioner sought regular bail for offences under Sections 115(2), 126(2), 109, 317(5) and 3(50) of the Bharatiya Nyaya Sanhita, 2023. The court examined the seriousness of the allegations and the involvement of the petitioner in the shooting. Concluding that the allegations were serious and the petitioner’s role was material, the court declined to grant regular bail. The application for regular bail was therefore rejected, with the court noting that its observations were prima facie and not determinative of the trial’s merits.
