The court granted bail to the petitioner, subject to bond and surety conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioner, Sunil Kumar, sought anticipatory bail in a case (Rafiganj PS Case No. 22 of 2026) filed under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 160 litres of illicit spirit and a motorcycle. He claimed innocence, stating no incriminating articles were found in his possession or residence, and that the seizure occurred in a public area based on secret information. The Additional Public Prosecutor opposed bail. The court, after considering the facts and the petitioner’s lack of criminal antecedents, ordered that if arrested or surrendered within six weeks, the petitioner be released on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The bail application was allowed.

Issues considered

  • What is the appropriateness of granting bail to the petitioner under the circumstances of the case?
  • Whether the petitioner poses a flight risk or threat to the investigation under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022?
