Bail is to be granted to the petitioner subject to the conditions stipulated under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioner, Nitish Kumar, was implicated in a case alleging recovery of 57 litres of illicit foreign liquor from a Swift Dzire car, under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. He contended that the liquor was not found in his possession or residence and that the accusation rested solely on statements of two apprehended individuals. The petitioner applied for bail, arguing innocence and lack of direct evidence. The court examined the facts, the statutory provisions, and the bail conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. It granted bail subject to a cash bond, sureties, and specific compliance conditions, including cooperation with the trial and non‑tampering with evidence. The application was allowed.

Issues considered

  • Whether bail should be granted to the petitioner under the circumstances of the alleged offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the allegations and the evidence presented justify denial of bail.
