Nitesh KumarversusThe State of Bihar

Decided

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Nitesh Kumar, a driver of a pickup van, was arrested in connection with the seizure of 1,109.52 liters of illicit liquor and charged under sections 30(a), 41(1) and 41(2) of the Bihar Prohibition and Excise Act. He contended that he had no possession of the liquor, was merely a driver, and had no criminal antecedents, having been in judicial custody since 4 April 2026. The State opposed his request for regular bail. After hearing both sides, the Patna High Court considered the facts, the lack of direct involvement, and the petitioner’s clean record, and decided to grant regular bail. The court ordered his release on a bail bond of Rs.10,000 with two sureties, subject to satisfaction of the Exclusive Special Judge, Excise, Samastipur. The order effectively disposed of the bail petition.

Issues considered

  • Whether the petitioner is entitled to regular bail for offences under sections 30(a), 41(1) and 41(2) of the Bihar Prohibition and Excise Act.
  • Whether the petitioner’s role as a driver and lack of direct possession justify granting bail.
