Sonu SahniversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner subject to monetary bond and attendance conditions.

Summary

Sonu Sahni was arrested in connection with a case registered under section 30(a) of the Bihar Prohibition and Excise Act for the recovery of three litres of illicit liquor allegedly found in a bag belonging to him. He had been in custody since 12 March 2026 and had one prior criminal antecedent. The petitioner applied for regular bail, arguing that the quantum of liquor recovered was modest. The Patna High Court, after hearing the parties, granted bail on the condition that the petitioner furnish a cash bond of Rs 10,000 along with two sureties of the same amount and report to the Maker Police Station on the first and third Sundays of each month. The Court clarified that its order was limited to the bail application and did not prejudice the merits of the trial.

Issues considered

  • Whether regular bail should be granted to the accused under section 30(a) of the Bihar Prohibition and Excise Act considering the quantity of illicit liquor recovered and the petitioner’s prior criminal antecedent.
