SADAN KUMARversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

Bail was denied to the petitioner.

Summary

The petitioner, Sadan Kumar, a school teacher, was arrested on 15 February 2026 and charged with sodomising a minor under sections 115(2), 351(2) and 126(2) of the Bihar Narcotic Substances Act, 2023 and sections 10, 12 and 4(1) of the POCSO Act. He applied for bail before the Patna High Court. The court examined the seriousness of the allegations, the nature of the offences involving a child, and the petitioner’s continued custody. Considering the gravity of the charges and the risk to the minor, the court was not inclined to grant bail. The bail application was therefore rejected, with the court noting that its observations were limited to the bail application and did not prejudice the merits of the trial.
