Patna High Court

Naval Raut @ Nawal PatelversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to specified monetary and attendance conditions.

Summary

Naval Raut was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly possessing 223 litres of illicit liquor, which the petitioner claims was recovered outside his house. He has been in custody since 30 January 2026 and faces two other similar charges. The petitioner pleaded innocence and offered to donate Rs.25,000 to a charitable organization without admitting guilt. The State opposed his bail application. The High Court, considering the circumstances and the petitioner's offer, granted regular bail on a bond of Rs.10,000 with two sureties, conditioned on a Rs.25,000 donation to the Ramakrishna Mission, production of the receipt, and weekly attendance at the Kotwa Police Station, clarifying that the order is limited to bail and does not prejudice the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail in a case under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether imposing a monetary donation to a charitable institution and weekly police station attendance are permissible conditions for bail.
