Patna High Court

Ajay Kumar @ Ajay RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to bond and surety conditions.

Summary

The petitioner, Ajay Kumar, was arrested in connection with a case alleging that he kidnapped a 17‑year‑old girl for the purpose of marriage. The FIR invoked sections 137(2), 96 and 3(5) of the Bihar Negotiable Substances Act, 2023. The victim’s statement under Section 183 of the same Act indicated that she voluntarily eloped with the petitioner, married him in Delhi, and there was no allegation of sexual assault. The petitioner, who has no prior criminal record, applied for anticipatory bail, which was opposed by the State. Considering the victim’s consent, the absence of sexual assault, and the petitioner’s clean record, the Court granted anticipatory bail subject to a bond and sureties, invoking Section 438(2) of the CrPC and Section 482(2) of the BNSS, 2023.

Issues considered

  • Whether anticipatory bail can be granted in a case involving alleged kidnapping of a minor for marriage
  • Whether the victim’s consent under Section 183 BNSS negates the criminal liability under sections 137(2), 96 and 3(5) of BNSS, 2023
  • Whether the petitioner’s clean record and lack of sexual assault allegation justify bail
