SIMON TUDD @ SEMAN TUDDUversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond of Rs. 10,000, two sureties, and attendance conditions.

Summary

Simon Tudd was arrested in connection with the recovery of 70 litres of illicit liquor from his house, alleged to be an offence under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner claimed innocence, stating that no liquor was found in his conscious possession, and had been in custody since 20 March 2026. The State opposed regular bail, while the petitioner’s counsel sought release. The court, after considering the facts and submissions, granted bail on a bond of Rs. 10,000 with two sureties, imposing a condition to attend the police station on the first and third Sundays of each month. The order was limited to the bail application and did not prejudice the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail in a case under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the circumstances of the case justify the grant of bail despite the alleged possession of illicit liquor.
