The court held that, in view of the absence of material linking the petitioners to the offence and their clean antecedents, anticipatory bail must be granted.
Summary
Vivek Kumar and Neeraj Kumar were implicated in a case involving the seizure of 194.7 litres of country-made liquor under Sections 30(a) of the Bihar Prohibition & Excise Amendment Act, 2022. They contended that the allegations were fabricated, relying only on statements of co‑accused and that no material linked them to the seized liquor. The State opposed anticipatory bail, invoking Section 76(2) of the Act. The High Court, referring to Ram Vinay Yadav v. State of Bihar (2019), considered the lack of substantive evidence and the petitioners' clean records, and granted anticipatory bail subject to strict conditions under Section 438 of the CrPC and Section 482 of the BNSS, 2023. The bail order required a bond of Rs 10,000 with two sureties, cooperation with the trial, and compliance with further conditions, with provision for cancellation on non‑compliance.
Issues considered
- Whether anticipatory bail can be granted under Section 438 CrPC in a case under the Bihar Prohibition & Excise Amendment Act, 2022.
- Whether the reliance on co‑accused statements without other material suffices to deny bail.
- Whether Section 76(2) of the Bihar Prohibition & Excise Act bars the grant of anticipatory bail.
