Bail was granted to the petitioner subject to a bond and specified conditions.
Summary
Mantosh Tiwari was arrested on 25 March 2026 in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2018, after 136.22 litres of liquor were seized, part of which was allegedly recovered from his motorcycle. The petitioner contended that he had no conscious possession of the liquor, that the seizure was made from the vehicle and not from him, and that the police failed to comply with Sections 103 and 105 of the BNSS. The prosecution highlighted five prior criminal cases against the petitioner, though he was on bail for those matters. The court examined the factual matrix, the alleged procedural lapses, and the petitioner’s antecedents, and decided to grant bail on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of criminal antecedents. The bail order was issued without delay for verification, and the petitioner was released.
Issues considered
- Whether bail should be granted to the accused in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2018 considering alleged lack of conscious possession and procedural non‑compliance.
- Whether the petitioner’s prior criminal antecedents affect the grant of bail.
