BAIL REJECTED

Holding

Anticipatory bail cannot be granted where the accusations are specific and direct, leading to the rejection of the petitioner's application.

Summary

The petitioner, Gaushami Ram, sought anticipatory bail in a case (PS Ariyari Case No. 121 of 2023) involving offences under multiple sections of the Indian Penal Code and Section 27 of the Arms Act. The prosecution alleged that the petitioner, along with other accused, assaulted the informant's son Shaturdhan Kumar and that co‑accused Ashok Ram fired at him, causing death, while the petitioner allegedly fired at the informant's elder son Arun Ram. The court examined whether the specific and direct nature of these accusations warranted the grant of anticipatory bail. Relying on the seriousness and clarity of the charges, the court concluded that the petitioner was not eligible for anticipatory bail. Consequently, the application for anticipatory bail was rejected.
