Lallu Kuamr @ Lallu SinghversusThe State of Bihar

DISMISSED

Holding

The application for regular bail was dismissed as there was no ground to review the earlier order.

Summary

Lallu Kumar (also known as Lallu Singh) was arrested on 16‑04‑2025 for alleged offences under IPC sections 341, 323, 307 and 34, and Section 27 of the Arms Act. He filed a second application for regular bail in Cr. Misc. No. 29669 of 2026 after an earlier bail plea was rejected on 15‑10‑2025. The petitioner argued that the case had not yet been committed to trial. The Court examined the seriousness of the charges, especially the alleged firing on the victim, and found no merit to revisit its earlier order. Consequently, the bail application was dismissed and the petitioner was directed to remain in custody until the case is committed by the Principal District Judge, Bhojpur.

Issues considered

  • Whether regular bail can be granted in a case involving serious offences under IPC and the Arms Act when the trial has not yet been committed.
  • Whether the earlier order denying bail can be reviewed on the ground of trial delay.

Patna High Court CR. MISC. No.29669 of 2026(2) dt.07-05-2026
                                                          2/2

                                                     3. The petitioner is the assailant of the
victim and is in custody since 16.04.2025.
                                                     4. Considering the allegation that the
petitioner has fired upon the victim causing injury, this
application for regular bail stands rejected.
                                                     5. However, if the trial is delayed, the
petitioner may renew his prayer for bail.

                                     3. It has been submitted by the learned counsel for

the petitioner that till now the case has not been committed.

                                     4. Considering the gravity of offence, this Court finds

no ground to review its earlier order.

                                     5. Accordingly, this application is dismissed again.

                                     6. The Principal District Judge, Bhojpur is directed to

commit the case at the earliest.
