Patna High Court

Manu Singh @ Mannu Singh @ Monu Singh @ Muna Kumar @ Munna Kumar @ Muna SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that regular bail may be granted despite the seriousness of the charges and prior absconding, provided the accused furnishes a bond and complies with the stipulated conditions.

Summary

Manu Singh and co‑accused were charged under IPC sections 323, 341, 307, 504 and 506/34 for allegedly assaulting an informant with lathi‑danda and iron rods. The petitioner had been in custody since 10 October 2025 and his earlier bail plea was rejected, with liberty to re‑apply after charge‑framing. He also faces another pending case (Tarari PS Case No. 13 of 2015) where he is on bail, and the State highlighted his prior absconding after an anticipatory bail denial in 2023. The court examined the seriousness of the offences, the length of detention, and the petitioner’s criminal antecedents, and concluded that bail could be granted subject to strict conditions. Accordingly, the court ordered regular bail on a bond of Rs 10,000 with two sureties and imposed conditions of personal appearance, surety composition, and verification of antecedents. The order expressly stated that the observations would not affect the trial and the application was allowed.

Issues considered

  • Whether regular bail can be granted in a case involving serious offences such as attempt to murder and criminal intimidation.
  • Whether the petitioner’s prior absconding and existence of another pending case preclude the grant of bail.
  • Whether imposing conditions on bail is appropriate under the circumstances.
