Patna High Court

Manish KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioners subject to specified conditions.

Summary

Manish Kumar and Ravi Mahto were arrested on 6 February 2026 in connection with Excise Case No. 818, based on an FIR dated 5 February 2026 alleging violations of Sections 30(a), 41 and 56(b) of the Bihar Prohibition & Excise Act, 2018. The police recovered 320 litres of country‑made liquor from a vehicle, but none was found in the petitioners' conscious possession and they claim they are not the owners of the vehicle. The petitioners argued that they have clean antecedents and that the seizure was conducted by police witnesses, violating Sections 103 and 105 of the Bihar Narcotic Substances (BNSS) Act, 2023. The State opposed bail, but the High Court noted the lack of direct possession, the procedural lapses, and the petitioners' clean record. Consequently, the Court granted bail on a bond of Rs.10,000 each with two sureties, subject to conditions of cooperation, presence in court, and non‑tampering with evidence or witnesses.

Issues considered

  • Whether bail should be granted to the accused in view of the alleged offences under the Bihar Prohibition & Excise Act, 2018.
  • Whether the seizure of liquor complied with the procedural requirements of Sections 103 and 105 of the BNSS, 2023.
  • Whether the absence of conscious possession and the petitioners' clean antecedents warrant bail.

appears from the F.I.R. as well as seizure list that nothing has

been recovered from the conscious possession of the petitioners

rather recovery has been made from the vehicle in question and

altogether 320.00 litres of country made liquor was recovered
