The Court granted anticipatory bail to the petitioner subject to specified conditions.
Summary
The petitioner, Niraj Kumar, was implicated in a case involving the recovery of 857.52 litres of illicit liquor under Sections 30(a) and 41 of the Bihar Prohibition & Excise Act, 2022. He asserted a clean antecedent and argued that his name was recorded only on the basis of a co‑accused’s statement, with no material linking him to the recovered liquor or any procedural compliance under Section 100 of the CrPC/Section 103 of the BNSS, 2023. The State opposed anticipatory bail, invoking Section 76(2) of the Act. Relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar, the Court granted anticipatory bail, imposing a Rs 10,000 bond, two sureties, and conditions under Section 438(2) CrPC and Section 482(2) BNSS, 2023. The bail order also required the petitioner’s cooperation in trial and allowed cancellation for tampering with evidence or concealment of antecedents.
Issues considered
- Whether anticipatory bail can be granted under Section 438 CrPC when the alleged offence is under the Bihar Prohibition & Excise Act and recovery procedures were not complied with.
- Whether the petitioner’s implication solely on the basis of a co‑accused’s disclosure suffices for arrest.
- Whether Section 76(2) of the Bihar Prohibition & Excise Act bars the grant of anticipatory bail.
