Patna High Court

Piyush KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to a bond and specified conditions.

Summary

Piyush Kumar was arrested on 29 March 2026 for allegedly possessing five litres of spirit liquor, alleged offences under Sections 30(a) and 37(B) of the Bihar Prohibition & Excise Amendment Act, 2022. He applied for bail, claiming innocence and arguing that the seizure was conducted by Bihar Home Guard personnel without complying with Sections 103 and 105 of the BNSS, 2023. The State opposed bail, noting that the petitioner has four other pending cases, though he is already on bail in those matters. The Court examined the procedural lapse and the petitioner’s criminal antecedents, and decided to grant bail on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, appearance, and non‑tampering with evidence. The bail order also directed the lower court to verify the petitioner’s criminal record without delaying the release.

Issues considered

  • Whether the alleged non‑compliance of Sections 103 and 105 of the BNSS, 2023 warrants granting bail.
  • Whether the petitioner is entitled to bail despite having other pending criminal cases.
  • Whether procedural lapses in seizure justify bail in the present offence under the Bihar Prohibition & Excise Amendment Act, 2022.

petitioner and Mr. Anil Kumar, learned APP for the State.

                                2. Petitioner seeks bail, who is in custody since

29.03.2026, in connection with Mashrakh P.S. Case No. 193 of

2026, F.I.R. dated 29.03.2026 registered for the offences

                                4. Learned counsel for the petitioner submits that the

petitioner is innocent and he has been falsely implicated in the

present case. He further submits that it appears from the F.I.R.

as well as seizure list that altogether 05 litres of spirit liquor was

further submits that it appears from the seizure list that seizure

list witnesses are Bihar Home Guard personnel so there is non-

petitioner and submits that the petitioner carries four more cases

other than the present one but fairly submits on the basis of

paragraph-3 of the bail petition that the petitioner is on bail in

          the pending matters.

                       6. Considering the facts and circumstances of the case

and the fact that there is non-compliance of Sections 103 and

105 of the BNSS, 2023, let the petitioner, above named, be

released on bail on furnishing bail bond of Rs. 10,000/- (Rupees
