Patna High Court

Sunil KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted because of the petitioner’s clean antecedent and the procedural lapses in the seizure.

Summary

The petitioner, Sunil Kumar, a driver, was arrested on 24 March 2026 in connection with the seizure of 8,981.28 litres of Indian‑made foreign liquor from a truck, alleged to violate Sections 274 and 275 of the Bihar Narcotic Substances Act (BNSS) and Section 30(a) of the Bihar Prohibition & Excise Amendment Act, 2022. He contended that he has a clean antecedent, is not the owner of the truck, and that the seizure was effected by “Hone Guard” personnel without compliance with Sections 103 and 105 of the BNSS, 2023. The State opposed bail, but the Court noted the procedural irregularities and the petitioner’s lack of prior convictions. Accordingly, the Court granted bail on a bond of Rs 10,000 with two sureties, subject to conditions of cooperation, appearance, and non‑tampering with evidence. The bail order also directed that verification of antecedents should not delay the release.

Issues considered

  • Whether the petitioner is entitled to bail despite the alleged non‑compliance of Sections 103 and 105 of the Bihar Narcotic Substances Act, 2023.
  • Whether the petitioner, as driver and not owner, can be held liable for the alleged offences under Sections 274, 275 BNSS and Section 30(a) of the Bihar Prohibition & Excise Amendment Act, 2022.
  • Whether the seizure of the liquor was lawful given the procedural requirements.
