The Court granted bail to the petitioners subject to specified conditions.
Summary
The petitioners, including Kundan Kumar and four others, were arrested in connection with a 2019 FIR alleging conspiracy to murder an informant's mother, involving offences under Sections 147, 148, 149, 302, 120B, 380 of the Indian Penal Code and Section 27 of the Arms Act. They had been in judicial custody since December 2025 and claimed they were falsely implicated, pointing to other co‑accused named in the FIR and noting that one co‑accused had already been granted bail. The State opposed the bail application, emphasizing the seriousness of the charges. The High Court examined the material on record, the lack of further incriminating evidence against the petitioners, and the principle of bail for accused persons. It ordered that bail be granted on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of criminal antecedents. The bail order was issued without delay for verification.
Issues considered
- Whether bail should be granted to the accused persons charged with offences under the IPC and Arms Act in a murder‑conspiracy case.
- Whether the presence of co‑accused and the seriousness of the charges justify denial of bail.
