Patna High Court

Shivam Kumar @ Suman KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on the basis that the FIR does not name him and no corroborative material has been produced.

Summary

Shivam Kumar was arrested on 11-11-2025 in connection with a case registered under Section 309(4) of the BNS. He was not named in the FIR; his name emerged only from the confessional statement of a co-accused, Sunil Kumar Pandey, and no other material or TIP has been produced by the prosecution. The State opposed bail, noting that the petitioner has four other pending cases, though he is already on bail in those matters. The court observed that the lack of direct inclusion in the FIR and absence of corroborative evidence warranted bail, subject to a bond of Rs.10,000 and two sureties, along with conditions of cooperation, presence in court, and non‑tampering with evidence. Accordingly, the petitioner was released on bail with the stipulated conditions.

Issues considered

  • Whether bail can be granted when the accused is not named in the FIR and the only allegation arises from a co‑accused's confessional statement.
  • Whether the absence of a TIP and lack of other material evidence justify bail despite the existence of other pending cases.
