Patna High Court

Pushkar Singh @ Pushkar Kumar SinghversusThe State of Bihar

Decided
Disposal
ALLOWED

Holding

Bail was granted to the petitioner with specified conditions.

Summary

The petitioner, Pushkar Singh, was arrested in connection with a planned loot and charged under IPC sections 399, 402, 120‑B and several provisions of the Arms Act. He had been in custody since 2 November 2023 and sought bail, offering an undertaking not to engage in any further criminal activity and to reside in Haryana. The State opposed the bail on the ground of the seriousness of the offences and potential flight risk. The High Court, after considering the facts, allowed the bail application, directing the petitioner to furnish a bail bond of Rs 10,000 with two sureties. The Court imposed conditions including residence at a specified address in Faridabad, regular attendance at the local police station, and limited travel to Bihar only for court appearances. Any default in compliance would result in cancellation of the bail.

Issues considered

  • Whether bail should be granted to an accused of dacoity, robbery, criminal conspiracy and arms offences.
  • Whether the petitioner poses a flight risk or threat to public order warranting denial of bail.
