Holding

Anticipatory bail was not granted to the petitioner.

Summary

Anand Kumar applied for anticipatory bail after being implicated in a motorcycle theft case (Jandaha PS Case No. 270 of 2025) under Sections 303(2), 317(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The petitioner claimed a clean record, but the recovered motorcycle and statements of three apprehended suspects linked him to the crime. The court examined the nature and gravity of the alleged offences and the possibility of the petitioner fleeing. Considering these factors, the court declined to grant anticipatory bail. The order also clarified that the observations were limited to this application and would not prejudice later proceedings.

                                       ORAL ORDER

2 08-05-2026 Heard the learned counsel for the petitioner and the

                   learned counsel for the State.

                                2. The petitioner apprehends arrest in connection with

Jandaha P.S. Case No. 270 of 2025 registered for offences

under Sections 303(2), 317(2) and 3(5) of the Bharatiya Nyaya

                   Sanhita, 2023.

                                3. The petitioner is alleged to be involved in

stolen motorcycle was recovered and three persons were

apprehended. During interrogation, they implicated the

petitioner as one of the accused who had fled from the spot.

                                4. Considering the nature and the gravity of the

offence, this Court is not inclined to grant the privilege of

anticipatory bail to the petitioner in the present case.

                                   5. Accordingly, the application for anticipatory bail is

                      hereby rejected.

                                   6. It is, however, clarified that the observations made
