The court allowed the modification, deleting the condition and extending the surrender period by four weeks.
Summary
The petitioner, Ranjeet Kumar Das, had been granted anticipatory bail on 12‑12‑2025 in Cr. Misc. No. 87237 of 2025, subject to a condition that the bail could be cancelled if the court found any other pending criminal case against him. The petitioner applied for a modification, contending that his wife, who was a deponent, was unaware of two other cases pending against him—one under Section 135 of the Bihar Electricity Act and several offences under the Bihar Negotiable Instruments Act. The court examined the claim and, considering the circumstances, allowed the modification application. It deleted the conditional paragraph that mandated cancellation of bail upon discovery of other cases and extended the period for the petitioner to surrender for an additional four weeks. The order thus relaxes the earlier bail condition and provides the petitioner more time to comply.
Issues considered
- What is the appropriate relief when a petitioner seeks modification of an anticipatory bail order on the ground that pending cases were not disclosed?
- Can the condition linking bail cancellation to discovery of other criminal antecedents be removed by the court?
