Patna High Court

Achchelal Paswan @ Achchelal ManjhiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a cash bond, sureties and specific conditions.

Summary

Achchelal Paswan was arrested on 21 March 2026 for possession of 14 litres of illicit country‑made liquor, alleged to violate Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Amendment Act, 2022. The petitioner applied for bail, contending that the seizure list was prepared by Home Guard personnel, thereby breaching mandatory provisions of Sections 103 and 105 of the Bihar National Security (or related) Act, 2023. The State opposed bail, noting the recovery from the petitioner’s house and an earlier criminal case, though the petitioner was already on bail in that matter. The Court examined the facts, the procedural issue of the seizure list, and the petitioner’s antecedents, and decided to grant bail on a Rs.10,000 bond with two sureties and several conditions regarding cooperation, non‑tampering, and disclosure of antecedents. The bail order was directed to be implemented by the Exclusive Special Excise Court, Saran.

Issues considered

  • Whether bail should be granted to the petitioner despite the alleged procedural lapses in the seizure process under Sections 103 and 105 of BNSS, 2023.
  • Whether the petitioner’s prior criminal antecedent and the nature of the offence under the Bihar Prohibition and Excise Amendment Act, 2022, preclude bail.

                               2. Petitioner seeks bail who is in custody since

          from raiding party.

                      4. Learned counsel for the petitioner submits that it

appears from the FIR and seizure list that 14 litres of illicit

country made liquor was recovered from the house of the

petitioner. It is next submitted that from perusal of the seizure

list it appears that the seizure list witnesses are Bihar Home

Guard personnel so there is non-compliance of mandatory

provisions of Sections 103 and 105 of BNSS, 2023 and

petitioner is in custody since 21.03.2026.

is on bail in the pending matter.

let the petitioner, above named, be released on bail on furnishing
