The Court granted bail to the petitioner with a bond and conditions, finding no statutory impediment to release.
Summary
Mukesh Paswan was arrested on 18 March 2026 after police seized 6.6 litres of Nepali liquor and 33 grams of ganja from his bicycle, charging him under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022 and Sections 20(ii)(a) and 22(a) of the NDPS Act. The petitioner sought bail, arguing that the seizure was conducted without compliance with mandatory provisions of Sections 103 and 105 of the Bihar Narcotic Substances (BNSS) Act, 2023, that the quantity seized was small, and that there was no embargo under Section 37 of the NDPS Act. The State opposed bail, citing three prior cases against the petitioner, though he was on bail in those matters. The Court considered the small quantity, lack of procedural compliance, and the petitioner’s bail status in other cases, and granted bail subject to a Rs.10,000 bond, two sureties, and conditions regarding cooperation, non‑tampering, and verification of antecedents. The bail order was directed to be implemented by the Special Excise Court without delay for verification.
Issues considered
- Whether the petitioner is eligible for bail despite charges under the Bihar Prohibition and Excise Amendment Act, 2022 and the NDPS Act.
- Whether non‑compliance with Sections 103 and 105 of the BNSS, 2023 invalidates the seizure and affects bail.
- Whether the quantity of liquor and ganja constitutes a 'small quantity' exempting the petitioner from an embargo under Section 37 of the NDPS Act.
- Whether the petitioner’s prior criminal antecedents justify denial of bail.
