Patna High Court

Ram Ashish SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Given the vague, omnibus allegations, simple injuries and the petitioners’ clean record, anticipatory bail was warranted.

Summary

The petitioners, nine male relatives from Alawal Chak, applied for anticipatory bail fearing arrest in a case registered under IPC sections 341, 323, 324, 307 and 34. The FIR alleged that they entered the informant’s house, abused and assaulted her family, causing injuries. The petitioners contended that the allegations were vague, omnibus, the injuries were simple, and pointed to a prior counter‑case (PS case No.66 of 2020) and their lack of criminal antecedent. The State opposed bail on the basis of the FIR. Considering the general nature of the allegations, the simplicity of the injuries and the petitioners’ clean record, the Court granted anticipatory bail subject to a bond of Rs 10,000 each with two sureties and conditions under Sec. 438(2) CrPC and Sec. 482(2) BNSS 2023, directing surrender within four weeks.

Issues considered

  • Whether anticipatory bail should be granted in a case involving alleged offences under IPC sections 341, 323, 324, 307 and 34.
  • Whether the general and omnibus nature of the allegations and the simplicity of the injuries justify the grant of bail.
  • Whether the petitioners’ clean criminal record warrants the relief of anticipatory bail.
