Anticipatory bail was granted to the petitioner, subject to conditions, as the allegations were not substantiated by direct material against her.
Summary
Sato Devi, the wife of alleged co-accused Bharthari Manjhi, was implicated in a case under Section 30(a) of the Bihar Prohibition & Excise Act after 4 litres of country-made liquor and 150-200 kg of Jawa Mahua were seized from her husband's house. She argued that no material was recovered from her possession and that she was named merely because of her marital relationship, having a clean antecedent. The prosecution opposed anticipatory bail citing Section 76(2) of the Act, which bars pre‑arrest bail. The High Court, relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar, held that the lack of direct evidence against her warranted the grant of anticipatory bail, subject to strict conditions. Accordingly, the court ordered that she be released on bail upon furnishing a bond of Rs.10,000 with two sureties and compliance with conditions under Section 438(2) CrPC and Section 482(2) of the Bihar Non‑Statutory Substitution Act, 2023.
Issues considered
- Whether anticipatory bail can be granted when the accused is implicated solely on the basis of marital relationship without direct evidence.
- Whether Section 76(2) of the Bihar Prohibition & Excise Act precludes anticipatory bail in such circumstances.
- Whether the procedural requirements under Section 100 CrPC and Section 103 of the Bihar Non‑Statutory Substitution Act, 2023, for recovery were complied with, affecting bail considerations.
