BAIL GRANTED

Holding

The application for regular bail was allowed.

Summary

The petitioner, Karan Tanti, was arrested in connection with a kidnapping case (Nathnagar P.S. Case No. 152 of 2025) under several provisions of the Bharatiya Nyaya Sanhita, 2023. The prosecution alleged that he kidnapped a girl, while the petitioner claimed innocence, citing a clean antecedent and that the girl had voluntarily eloped and married him, as recorded under Section 183 of the BNSS. The State opposed the bail application, but the court, after reviewing the victim's statement and the circumstances, found no substantive reason to deny bail. Consequently, the court granted regular bail on the condition of a Rs.10,000 bond with two sureties. The order was limited to the bail application and does not prejudice the merits of the ongoing trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious kidnapping charges under the Bharatiya Nyaya Sanhita.
  • Whether the victim's statement of voluntary elopement and marriage negates the alleged kidnapping.
  • Whether the petitioner's clean antecedent warrants bail.
