Regular bail was denied to the petitioner.
Summary
The petitioner, Ram Babu Rai, was charged with murder, criminal conspiracy and illegal possession of arms under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act. He is alleged to have conspired with co‑accused to kill the informant’s uncle, Dev Kumar Singh, to silence witnesses, and the murder involved firearm injuries. The petitioner has been in custody since 9 November 2025 and has eleven prior criminal convictions. The bail application sought regular bail, but the court considered the seriousness of the offences, the conspiratorial nature of the crime, and the petitioner’s criminal antecedents. Consequently, the court rejected the application for regular bail, noting that its observations were prima facie and would not affect the trial’s merits.
Issues considered
- Whether regular bail should be granted to the petitioner given the gravity of the murder and conspiracy charges, the involvement of firearms, and his extensive criminal antecedents.
