Patna High Court

Hakim SahaniversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to specified conditions.

Summary

The petitioner, Hakim Sahani, was arrested in connection with a violent incident alleged to have occurred on 20 November 2025, involving assault, robbery and homicide attempts, for which he faces multiple offences under the Bihar Non‑Applicable Statutes (BNS). The prosecution’s case is based on a written statement by the informant describing the assault and looting by several co‑accused, with the petitioner alleged only to have given orders. The petitioner’s counsel argued that he has a clean antecedent, is not specifically named in the FIR, and that his alleged role was limited to ordering, not personally assaulting anyone. The Additional Public Prosecutor opposed bail, citing the seriousness of the charges. The court, after considering the facts, granted bail on a Rs.10,000 bond with two sureties, imposing conditions of cooperation, appearance, non‑tampering with evidence, and verification of antecedents.

Issues considered

  • Whether the petitioner, who is alleged only to have given orders and is not specifically named in the FIR, is entitled to bail despite the serious nature of the offences.
  • Whether the petitioner’s clean antecedent and lack of direct participation in the assault justify granting bail.
  • Whether the conditions imposed are sufficient to ensure the petitioner’s cooperation and prevent tampering with evidence.
