Decided

Holding

Anticipatory bail was not granted as the case was not deemed fit for such relief.

Summary

The petitioner, Somitullah @ Tanveer, sought anticipatory bail fearing arrest in a case concerning the alleged recovery of 16,000 litres of raw spirit. The FIR dated 5 October 2019 charges him under IPC sections 272 and 273 and the Bihar Prohibition and Excise Act sections 30(A), 33, 41 and 47. He contended that the allegations are fabricated, that his name was disclosed by an apprehended co‑accused, and that he is innocent. The State opposed the bail, highlighting that the petitioner is implicated in ten similar cases. After considering the facts, the Court held that the circumstances did not warrant the grant of anticipatory bail. Consequently, the petition for anticipatory bail was refused.

                                        5. Learned APP for the State, on the other hand,

opposed the prayer for anticipatory bail of the petitioner and

submits that from perusal of the paragraph-3 of the bail petition

of the case, this is not a fit case for grant of anticipatory bail and
